Voter Apathy Possibly Rears its Ugly Head

Despite the efforts of Peggy Zahler, John Bradley and Rusty Tidwell to promote the forum, last night’s Clear Creek Village candidate’s forum was under attended. Subtract out the Politicians, there were 28 people in the audience. A quick check of the CCVHOA website mentions nothing about the forum and none of the surrounding West Side HOA's websites. Doesn’t anyone care anymore?

Doesn't Anyone Care Any More?
Today I was driving down the road on South Shore Blvd. I came to the intersection of Compass Rose and South Shore Blvd, and there was a sea of broken tempered glass lying across the road. Apparently, the glass came from the door of an entertainment center or some such thing. The person, who lost the door, had to have known they lost it and caused a mess on some road. However, they never gave it another thought and left it for someone else to deal with it. Doesn't anyone care anymore?

Candidates Forum 4-26-10
This forum is all about League City citizens. Join us, have your voice heard, and become informed of ballot propositions so you can participate by your vote in determining the future of our city.
At 7 PM promptly the Candidates Forum will begin. This forum is structured to give the citizens an opportunity to ask questions important to them. The three candidates for Position 7 will be in attendance.
Reference the article below for additional details about our Candidates Forum for CCV and the West Side including the Charter Amendment Propositions.
I want to let you know the format of the forum. It is a format was used on the West End in Galveston for a Mayoral forum a few weeks ago, and it was very well received--from candidates as well as attendees. At this time, it has been decided that Peggy Zahler will be the moderator.
The format is as follows:
Three questions from the CCV Board will be provided to you a few days before the forum. These questions will be asked first and will be answered by each of you.
Drawing among candidates for order of seating/speaking
Each candidate will be given 2 minutes to introduce themselves
I will ask each candidate the CCV Board's 3 questions
Questions from the floor will then be asked. There will be no debate or follow-on question until other attendees have a chance to ask a question. This will prevent one or two attendees from monopolizing the time.
Each candidate will have a chance to answer every question asked and will be given 2 minutes
At attempt will be made, within a reasonable amount of time, to address as many questions as possible
Each candidate will be given 2 minutes to summarize their position/closing remarks
The timer from the League City Chamber will be used to enforce time limits. It is our intent to strongly enforce time limits such that all candidates have equal time.
After the candidates panel, there will be a brief presentation by City Council representatives on the Charter Review Propositions. It is planned that two citizens will then briefly discuss their preferred form of government.
Neil Baron & Mick Phalen will speak on behalf of the City on the Charter Amendments.
Charter Review Member's Marc Edelman will speak why he supports Council Manager Form of Government and Chris Mallios will speak on why he supports Strong Mayor Form of Government.
The Candidates Forum will begin at 7 PM. Depending on the questions and the turnout, your part should last no longer than an hour.
We will do everything we can to encourage a large turnout, and we are including other West Side subdivisions in our invitation.
This will allow the Citizens to ask the questions that they want to get the Candidates position on and also help educate everyone on the Charter Review Propositions.
Any questions, please feel free to call me. All are welcomed.

Judge Finds for Defendant and Intervening Party in Twin Timbers Law Suit

Today the Judge 405th State District Court, Judge Wayne Mallia, in the case of 3:09 McGahee et al vs City of League City issued a summary Judgement in favor of the defendant the City of League City and a an intervening party with regards to the Twin Timbers Lawsuit. Residents along Twin Timbers street in League City, filed a lawsuit against the City of League City, alleging that the city's Planning and Zoning Commission wrongfully approved plats for a subdivision adjoining the canal, Cypress Bay, in violation of it's own ordinances barring new canals being built within 50 feet of a property line. The judge determined that the canal in question was an existing canal and so therefore the ordinance does not apply to this situation. It is sad that the citizens and the business people of this community must pay for lawsuits of this nature. I hope that the good citizens of League City will read about this legal action against the city and realize that these lawsuits have a tremendous cost to the city. In my opinion, the citizens should hold the plaintiffs behind these lawsuits accountable to reimburse all of us for the legal defense of these types of legal actions brought against the city.

Your implication that some how money is corrupting the process is outrageous. As a League City resident I have been watching this project very carefully. It has been done in a class A manner. I do not believe that the developer has broken any city, state or Tx dept of transportation rules. This particular issue is in a gray area. The ordinance says
"Canals, marinas, and other bodies of water that are created by dredging or removing land from existing land and connecting ultimately to navigable water must be a minimum of 50 feet from property that abuts the property from which the land is being removed."
In my opinion, this was an existing canal so it was not created by the developer. Its prior non conformance is most likely the question to be addressed, but that canal was there before zoning, so the no harm no foul rule should apply.

Mr. Edelman,
Actually, in this case you are incorrect. The old canal that was in the vicinity of the properties in question in this lawsuit was above sea level and much smaller in width than the new canal. The Cypress Bay project dug it down to sea level depth and greatly widened it and removed the dam at the end of it, thus effectively creating a new canal. Furthermore, the previous canal was constructed prior to the neighborhood now including Twin Timbers being created and I believe prior to that area even being incorporated into the city, so there could have been no 'prior non conformance'. I know that you are well aware of this history. (As a member of the city government, it would be prudent for you to be more accurate in your factual statements regarding yet another lawsuit against the city.)
Just one of many issues where the Cypress Bay development has caused unnecessary and unreasonable grief for its neighbors. It is most unfortunate that the city government did such a poor job of watching this project. In fact, it would be quite reasonable to argue that this development has seen the poorest oversight by the city of any development in League City history.
Mr. Badder,
You are correct that the history of this project raises many questions. I have posted a number of documents that you may find of interest to starting your inquiries at this link:
Jeff Hagen's link
For example, by comparing the arial view posted as item 19 to Google Earth views prior to recent construction, you can see that Mr. Edelman's above statement is factually incorrect.

Candidates Forum Tonight at Council Chambers.

What are the issues you want to hear about. Here are some oldies but goodies.
1. Traffic Relief.
2. Single Member districts
3. Problems with existing drainage and infrastructure
4. Economic development to attract new businesses to defray tax burden from residential property.
5. How to handle a city government with falling revenues from ad valor em taxes.
6. PBK Architects did a facilities study on the city complex and recommended a new facility be built, do you support this?
7. Should residential growth be curtailed by increased requirements for parkland, code requirements and other regulatory items, allow the market to regulate growth, or should we just flat tell them to leave?
8. Should we establish the 1/4 cent sales tax to enable a tool to do real economic development?
9. Form of Government, should we change from strong Mayor to Council Manager?
10. If we install new improved capacity infrastructure systems, how are we going to accommodate the new residents that will come from more home building that would be made possible. Traffic, Public Safety, Personnel increases at city hall to handle increased population? City Hall Satellite centers around town?
Please feel free to jump in and state your issues or questions for tonight.
